Terms of Service

1. Acceptance of Terms

By accessing or using the AstroAPI service ("Service"), including our astrology calculation APIs, documentation, and related services, you agree to be bound by these Terms of Service ("Terms"). If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

If you do not agree to these Terms, you may not access or use the Service. We reserve the right to update these Terms at any time, and your continued use of the Service constitutes acceptance of any modifications.

2. Description of Service

AstroAPI provides a comprehensive astrology calculation API service offering over 56 calculation types, including natal charts, transits, progressions, solar returns, synastry, and more. The Service includes:

• RESTful API endpoints for astrological calculations
• Support for 23 house systems and 97+ Arabic parts
• Multi-language support (9+ languages)
• API documentation and integration guides
• Dashboard for API key management and usage monitoring
• Technical support based on your subscription tier

3. Account Registration and API Keys

To use the Service, you must register for an account and obtain API keys. You agree to:

• Provide accurate, current, and complete registration information
• Maintain the security of your account credentials and API keys
• Immediately notify us of any unauthorized use of your account
• Accept responsibility for all activities under your account
• Not share, publish, or distribute your API keys publicly

Each API key is unique to your account and must not be shared with third parties. You are responsible for all usage associated with your API keys, including any overage charges.

4. Acceptable Use Policy

You agree to use the Service only for lawful purposes and in accordance with these Terms. You specifically agree NOT to:

• Use the Service to violate any applicable laws or regulations
• Attempt to gain unauthorized access to our systems or networks
• Interfere with or disrupt the Service or servers
• Reverse engineer, decompile, or attempt to extract source code
• Use automated means to scrape or extract data beyond API limits
• Resell or redistribute the Service without explicit written permission
• Use the Service to create competing products or services
• Transmit malicious code, viruses, or harmful data
• Violate the intellectual property rights of others
• Use the Service for illegal gambling or fraudulent activities

5. API Rate Limits and Fair Use

API usage is subject to rate limits based on your subscription tier:

Rate limits are enforced on a per-second and per-month basis. Exceeding your rate limits may result in:

• Temporary suspension of API access (429 status codes)
• Overage charges as specified in your plan
• Requirement to upgrade to a higher tier

6. Intellectual Property Rights

AstroAPI and its licensors retain all rights, title, and interest in and to the Service, including all software, algorithms, APIs, documentation, and related intellectual property. These Terms do not grant you any rights to use AstroAPI trademarks, logos, or branding without prior written permission.

You retain all rights to your content and data processed through the Service. By using the Service, you grant AstroAPI a limited, non-exclusive license to process your data solely for the purpose of providing the Service.

7. User Content and Data

You are responsible for all data and content you submit to the Service ("User Content"). You represent and warrant that:

• You have the right to submit User Content
• User Content does not violate any third-party rights
• User Content complies with applicable data protection laws
• You have obtained necessary consents for personal data processing

We process User Content in accordance with our Privacy Policy. We do not claim ownership of your User Content and will not access it except as necessary to provide the Service or as required by law.

8. Payment Terms

Paid subscriptions are billed monthly in advance. By subscribing to a paid plan, you authorize us to charge your payment method on a recurring basis. Subscription fees are based on the selected tier:

All fees are non-refundable except as required by law. Price changes will be communicated at least 30 days in advance. You may cancel your subscription at any time, with cancellation taking effect at the end of the current billing period.

9. Service Level Agreement

AstroAPI commits to maintaining 99.9% uptime for paid plans, measured monthly. This excludes:

• Scheduled maintenance (communicated 48 hours in advance)
• Force majeure events
• Issues caused by factors outside our reasonable control
• Downtime resulting from your actions or third-party services

Response time targets average ~300ms for standard calculations. Complex calculations may take longer. Enterprise customers receive priority support and dedicated infrastructure as specified in their agreements.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ASTROAPI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING FROM YOUR USE OF THE SERVICE.

IN NO EVENT SHALL ASTROAPI'S TOTAL LIABILITY EXCEED THE AMOUNT PAID BY YOU TO ASTROAPI IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

11. Indemnification

You agree to indemnify, defend, and hold harmless AstroAPI, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

12. Termination

We may suspend or terminate your access to the Service immediately, without prior notice or liability, if you breach these Terms or engage in any conduct that we determine, in our sole discretion, to be inappropriate or harmful to the Service or other users.

Upon termination, your right to use the Service will immediately cease. All provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, and limitations of liability.

13. API-Specific Terms

13.1 API Versioning

We may release new API versions periodically. Deprecated versions will be supported for at least 6 months after deprecation notice. You are responsible for updating your integration to use supported versions.

13.2 Webhooks

If you use webhooks, you must implement proper security measures including signature verification. Failed webhook deliveries will be retried with exponential backoff for up to 24 hours.

13.3 Caching

You may cache API responses for reasonable periods. However, you must respect cache headers and not cache sensitive or user-specific data beyond session boundaries.

13.4 Attribution

Free plan users must provide visible attribution to AstroAPI in their applications. Paid plans do not require attribution but it is appreciated.

14. Data Protection and Privacy

We process personal data in accordance with applicable data protection laws, including GDPR and CCPA. As a data processor, we will:

• Process data only according to your instructions
• Implement appropriate technical and organizational security measures
• Delete or return data upon termination of service
• Assist with data subject requests and compliance obligations
• Maintain confidentiality of all processed data

For Enterprise customers, we offer Data Processing Agreements (DPAs) upon request.

15. Modifications to Terms

We reserve the right to modify these Terms at any time. Material changes will be notified via email at least 30 days before taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

16. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms shall first be addressed through good faith negotiations. If resolution cannot be reached within 30 days, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association.

17. General Provisions

17.1 Entire Agreement

These Terms constitute the entire agreement between you and AstroAPI regarding the Service and supersede all prior agreements and understandings.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.

17.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term.

17.4 Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
